Terms and Conditions

1. Introduction

These Terms and Conditions ("Agreement") are entered into by and between MonkeyWeb SIA ("MonkeyWeb.lv," "we," "our," or "us") and the customer ("Customer," "you," or "your"). By signing this Agreement, you agree to be bound by the terms and conditions outlined herein for the use of MonkeyWeb.lv's fulfillment services, including storage, packing, and shipping services. This Agreement governs the rights, obligations, and responsibilities of both parties.

2. Services Offered

MonkeyWeb.lv provides fulfillment services which include but are not limited to storing, packing, and shipping products on behalf of the Customer. We collaborate with carriers such as DPD, UPS, DHL, Itella, Latvian Post, and Express Post to facilitate efficient and reliable shipping.

3. Agreement Duration

This Agreement shall commence on the date of signing and continue indefinitely until either party provides written notice of termination at least 30 days in advance.

4. Service Initiation

To initiate cooperation with MonkeyWeb.lv, the Customer must sign this Agreement and provide accurate and complete information about their products, packaging requirements, shipping preferences, and other relevant details.

5. Customer Responsibilities

• The Customer is responsible for ensuring that all products provided to MonkeyWeb.lv for storage, packing, and shipping are legal, safe, and comply with all applicable laws and regulations.
• The Customer must promptly update MonkeyWeb.lv about any changes in product details, inventory levels, packaging requirements, and shipping preferences.
• The Customer shall provide accurate shipping addresses and contact information for recipients of shipped products.

6. Payment

• The Customer agrees to pay MonkeyWeb.lv according to the pricing and payment terms outlined in the Agreement.
• Payment shall be made in the currency specified in the Agreement and must be received by the due date to maintain uninterrupted services.

7. Shipping

• MonkeyWeb.lv will use its best efforts to ensure timely and accurate shipping of products using the carriers specified in the Agreement.
• Shipping fees, customs duties, taxes, and any other applicable charges related to shipping are the responsibility of the Customer unless otherwise agreed upon.

8. Liability and Insurance

• MonkeyWeb.lv shall take reasonable care in handling and storing products; however, we are not liable for damage, loss, or theft of products that occur during storage, packing, or shipping.
• It is recommended that the Customer maintains insurance coverage for their products during transit and storage.

9. Confidentiality

Both parties agree to treat any non-public information shared during the course of the cooperation as confidential. This includes but is not limited to product information, business strategies, and customer data.

10. Termination

Either party may terminate this Agreement by providing written notice at least 30 days in advance. Upon termination, the Customer shall settle any outstanding balances and retrieve their products from MonkeyWeb.lv's facilities.

11. Governing Law and Disputes

This Agreement shall be governed by and construed in accordance with the laws of the Republic of Latvia. Any disputes arising from this Agreement shall be resolved through amicable negotiations. If no resolution is reached, disputes shall be subject to the exclusive jurisdiction of the courts of Latvia.

12. Amendments

MonkeyWeb.lv reserves the right to amend or modify these Terms and Conditions at any time. Customers will be notified of any changes, and continued use of the services after notification constitutes acceptance of the updated terms.
